Notice of Infringement
The iRok2 service is designed for users to extend their enjoyment of music videos to which they have legal access. iRok2 does not store or transmit any video or audio content. In the case that you believe that an iRok2 game track includes a link to a music video that infringes your copyrights, or other intellectual property rights, please provide iRok2’s Agent for Notice with the following information (your “Notice”):
- The Title of the video concerned and the full URL that activates its playback from its source site.
- The country your copyright applies to.
- The type of copyright work you own the rights to and that you believe has been infringed (e.g. film, music, book and title with publication details),
- An explanation of how the video infringes your copyright.
- Your contact information so we can follow up with you (email address is most efficient)
- Your contact information that we can give to the person that linked an iRok2 game to the video referenced so that they may attempt to resolve your complaint directly with you (again, email address is most efficient).
- Your Notice should contain the following statements (which are provided under penalty of perjury):
- A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- You must sign the Notice. If you are providing notice by email, a scanned physical signature or valid electronic signature is acceptable.
Actions upon Notice
On receipt of the Notice containing the information outlined above iRok2 will remove or disable any link from the iRok2 game to the video that is alleged to be infringing. iRok2 will, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may infringe or repeatedly infringe the copyrights or other intellectual property rights of others.
The information provided in your Notice may be forwarded to the person who created the link to the allegedly infringing content who has the right to file a Counter Notification with us disputing your claim. If due legal process resolves the dispute in favor of the Counter Notifier, the removed link may be restored. If you are not sure what your rights are, or whether your copyright has been infringed, you should check with a legal adviser first. Be aware that there may be adverse legal consequences in your country if you make a false or bad faith allegation of copyright infringement by using this process.
Other Measures a Rights Holder May Take
iRok2 does not store or transmit any video or audio content. Removing a link from an iRok2 game to an infringing video will not remove the video from its host site. iRok2 cannot monitor or enforce your intellectual property rights on sites over which we have no control. However, most sites that do store or transmit video or audio content have their own procedures for providing Notice of Infringement. For instance, YouTube provides procedures for notifying infringement and removing infringing videos. Following these procedures for removing an infringing video from its host site will result in any link to it from an iRok2 game ceasing to access the video.
In the case that you, as a valid rights-holder, wish iRok2 to block access to your video from the iRok2 site while retaining access to it from the host site directly, you may use two methods:
- File a Notice with iRok2 as described above. This will result in the removal of the link from iRok2 to the video on its host site, but will not affect the host site in any way.
- Disable “Embedding” on the host site. Some video host sites (for instance, YouTube) provide a mechanism by which external sites may display the host site content within a player running on the external site. This feature may be disabled by a rights holder without removing the video from the host site. By disabling videos in this manner you will prevent iRok2 games from linking to the video, but will continue to allow access through the host site.
